Vulnerability, Suggestibility and Misconduct

Why people are more vulnerable and suggestible during psychedelic sessions, what is known about misconduct reports, and which reporting routes we could verify.

If something has happened to you

You are not at fault. If you are in danger now, call 911 (United States). For emotional crisis in the US, call or text 988, which Oregon's health authority lists on its psilocybin program page. [1] If the conduct was a crime, the Oregon Health Authority says to contact law enforcement. [2] Other countries have their own numbers, which we have not verified here.

Why this topic exists

During a psychedelic session a person may feel open, confused or unable to protect themselves. The FDA says people who receive active treatment may stay in a vulnerable state for several hours or longer, and expects consent forms to mention changes in perception, cognition and judgment and increased vulnerability and suggestibility. [3] Researchers add that consent given under the drug's effects is harder to rely on. [4]

Evidence label used here: insufficient evidence means too few good studies to measure how common something is.

What is documented about misconduct

  • A bioethics paper notes that the FDA's 2024 decision on an MDMA therapy application raised, among many issues, concern about a highly publicized case of alleged sexual misconduct by an unlicensed therapist during a Phase 2 study. The same paper refers to other publicized cases involving guides, facilitators and shamans at psychedelic retreats. [5]
  • An anonymous online survey of 1,221 people who had used psychedelics found that 8% said they or someone they know was the victim of inappropriate sexual contact by a sitter, guide or practitioner. [6] This does not give a rate of misconduct. The group was self-selected, the wording covers people "they know", and one event could be counted by several respondents.
  • We found no reliable figure for how often misconduct happens in regulated clinical care. Proper evidence not found in the sources read. Researchers instead call for clearer guidelines and training on boundary breaches. [4]

Reporting

The sources read do not measure how often harm is reported or acted on. Proper evidence not found. The routes below are the ones we could confirm from official pages.

Reporting routes we could verify

Which route fits depends on where it happened and who was involved.
SituationVerified routeNote
CrimeLaw enforcementOregon's health authority directs criminal complaints there. [2]
Licensed psilocybin service in Oregon, USAOregon Psilocybin Services complaint process (online or mailed form)It investigates violations of Oregon law on licensed premises, and says complaints can be kept confidential at your written request. [2]
Problem with a medicine or medical product in the USFDA MedWatchDescribed by FDA as its safety reporting program for health professionals, patients and consumers. [7] We did not see it described as a place for conduct complaints.
Professional licensing board, ethics committee for a trial, or regulators outside the USNot verifiedWe could not read a board directory this session. Ask the clinic or trial team for its complaint process in writing.

Some complaint offices only cover their own laws. Oregon's, for example, says it investigates violations of Oregon psilocybin law. [2] A report to one office may therefore not lead to action on something that falls under another.

Looking after yourself afterward

Many people want to talk with someone they trust or a clinician. See talking with a health professional and when to seek urgent help. For the preparation and consent that should come beforehand, see informed consent and professional boundaries.

What this page does not do

It does not list providers, rank services or advise anyone to take a substance. Naming a case does not mean every practitioner is unsafe.

Frequently asked questions

Are people really more suggestible during a session?

The FDA guidance uses the words increased vulnerability and suggestibility and asks that consent forms say so. [3]

How common is sexual misconduct in psychedelic care?

Nobody knows. One self-selected survey found 8% reported that they or someone they knew had experienced inappropriate sexual contact, but it cannot give a true rate. [6]

Where do I report a problem with a licensed Oregon psilocybin service?

The Oregon Health Authority's psilocybin program takes complaints online or by mailed form about violations on licensed premises. [2]

Does reporting to FDA MedWatch cover misconduct?

MedWatch is for medical product safety problems. [7] We did not find it described as a route for conduct complaints.
